2707 LEGAL NOTICE NOTICE OF TRUSTEE'S SALE OF LAND Under and by virtue of the authority vested in me as ­Trustee in that certain Deed of Trust dated July 29, 2008 executed by Diane G. Taylor, Larry A. Gresham and Sondra G. Wilburn unto William F. Schneller as Trustee, to secure an indebtedness therein described to Merchants and Farmers Bank said Deed of Trust being of record in Land Deed of Trust Book 203 page 60-64 and further identified as Instrument No 200800883; Deed of Trust dated March 22, 2011 executed by Diane G. Taylor, Larry A. Gresham and Sondra G. Wilburn unto William F. Schneller as Trustee, to secure an indebtedness therein described to Merchants and Farmers Bank said Deed of Trust being of record in Land Deed of Trust Book 214 page 692 and further identified as Instrument No 201100297 all in the land records of ­ the Clerk of the Chancery Court of Benton County, Mississippi; and default having been made in the payment of the indebtedness thereby secured, and the undersigned having been requested by the legal holder of said indebted­ness to foreclose said Deed of Trust, notice is hereby given that I, as Trustee aforesaid, will, within lawful hours, at the North front door of the Benton County Courthouse, in the City of Ashland, Mississippi, on FRIDAY, JULY 26, 2019 offer for sale and sell at public outcry to the highest bidder for cash, the following described property, situated in the County of Benton, State of Mississippi, to wit: Indexing Instructions: 47.80 acres more or less (Tax Assessor Map No 1-065-03-000-061.0) in the Northeast Quarter of Section 3, Township 3 South, Range 1 East Benton County, Mississippi described as: Forty acres more or less the same being the northwest quarter of the northeast quarter of Section 3, Township 3 South, Range 1 East. Source Deed: This is the same land and property as conveyed to Twyla Akin Gresham by Deed of Gift dated February 23, 1957 and executed by W. T. Akin and wife, Annie Graves Akin, recorded in Land Deed Book No 35 page 526 on February 23, 1957 at 3:15 p.m. in the office of the Chancery Clerk of Benton County, Mississippi. ALSO: Beginning at the northwest corner of Section 3, Township 3 South, Range 1 East and running East 2640.0 feet to a stake; thence South 1320.0 feet to a set stake; thence East 880.0 feet to a set stake and the point of beginning of the parcel of land hereby conveyed; thence South 693.0 feet to set stake; thence East 880.0 feet to a set stake and the point of beginning containing 14 acres more or less. Source Deed: This is the same land and property as conveyed to Twyla Akin Gresham by Deed of Gift dated August 21, 1957 and executed by Blanche Akin Walker recorded in Land Deed Book No 38 page 30 on August 22, 1957 at 8:25 a.m. in the office of the Chancery Clerk of Benton County, Mississippi. Subject to rights of way and easements for public road and utilities. Subject to laws, ordinances and regulations which govern the use and occupancy of this land enacted by the United States of America, the State of Mississippi and its political subdivisions and particularly including the subdivision regulations and zoning ordinances adopted by ordinances of the Board of Supervisors of Benton County, Mississippi none of which render title unmarketable. LESS AND EXCEPT: That certain tract of land containing 6.2 acres more or less conveyed to Farmers Gin Company Inc recorded in Land Deed Book No 102 at page 58 in the office of the Chancery Clerk of Benton County, Mississippi. Subject to all easements and rights of way for public roads, utilities and highway easements and gas transmission lines which might cross said property. Source Deed: This is the same land and property conveyed by Twyla A. Gresham to Diane G. Taylor, Larry A. Gresham and Sondra G. Wilburn by warranty deeds recorded in Land Deed Book No 157 at pages 157 and Land Deed Book No 157 at page 347 et seq in the office of the Chancery Clerk of Benton County, Mississippi. The purchaser will be required to pay the full amount of his bid in cash at the time of the sale. I will sell and convey only such title as is vested in me as Trustee.
