NOTICE OF ADOPTION OF A
REZONING ORDINANCE
BY THE MAYOR AND BOARD OF
ALDERMEN OF THE CITY OF
AMORY, MISSISSIPPI
WHEREAS, the City of Amory on the 21st day of July 2020, adopted an Ordinance,
being Ordinance No. 1727, rezoning certain property located in the City of Amory
from Residential 2 (R2) to Industrial 1 (M1); and
WHEREAS, Section 21-17-19, Mississippi Code Annotated of 1972, as amended,
provides that whenever a municipality is required to publish a public measure,
including an ordinance, the substance of the ordinance may be printed in lieu of the
full text of the ordinance as provided in said section; and
WHEREAS, the substance of the ordinance shall be an explanatory statement summarizing the full text of the ordinance in which the chief purpose of the ordinance is
explained and clear in unambiguous language; and
WHEREAS, in the event publication is made in the manner described by Section
21-17-19, the statute provides that during the entire time of publication of the
explanatory statement in a newspaper, a copy of the full text of the public measure
or the amendment thereto, shall be posted by the clerk of the municipality (a) at the
city hall, (b) at the main public library in the municipality, or at the courthouse in
the judicial district or county in which the municipality is located; and in addition,
the clerk shall post such copy at least at one (1) other public place in the municipality
and further the clerk shall furnish any resident of the municipality a copy of the full
text of the public measure upon request; and
WHEREAS, in consideration of the above and foregoing statute, the City of Amory,
Mississippi, does hereby give notice as follows:

NOTICE

The City of Amory, Mississippi, as allowable by Section 21-17-19, Mississippi Code Anno-

tated of 1972, as amended, does hereby publish and give notice to all citizens and
interested persons that an ordinance has been adopted, being Ordinance No. 1727,
rezoning certain property located in the City of Amory from Residential 2 (R2) to
Industrial 1 (M1);); and
WHEREAS, the decision of the Development Board in favor of the rezoning was
filed to the Mayor and Board of Aldermen and a public hearing was held July 21,
2020 for the rezoning request on the following parcel:
REZONE FROM RESIDENTIAL 2 (R2) to INDUSTRIAL 1 (M1);

WHEREAS, the Mayor and Board of Aldermen have reviewed the character of
the neighborhood and the public need for rezoning of the property; and
WHEREAS, upon review of this matter and careful consideration of all facts,
comments, and documentation, the Mayor and Board of Aldermen find that the
character of the neighborhood has changed substantially so that rezoning is clearly
justified, and that there is a public need for the rezoning of the property; and
WHEREAS, pursuant to Section 21-17-5 M.C.A., the City has the power to
adopt any orders, resolutions or ordinances with respect to such municipal affairs,
property and finances which are not inconsistent with the Mississippi Constitution of 1890, the Mississippi Code of 1972, or any other statute or law of the State
of Mississippi; and
In accordance with the requirements of Section 21-17-19, M.C.A., a copy of the
full text of the ordinance described herein shall be posted at Amory City Hall, the
main public library, and the Monroe County Government Complex.
The Municipal Clerk of the City of Amory shall furnish any resident of the municipality a copy of the full text of this ordinance upon request.
This Ordinance was passed and adopted by unanimous vote on this the 21st day
of July 2020.
