BALDWYN - One of two cousins charged with capital murder in death of a Baldwyn man was released this week.
Kenneth W. Scales, 33, of Route 7, Box 364, Corinth, was released Wednesday on a $100,000 bond.
Originally, he and his cousin, Dennis L. Scales. 33, of Route 7 Box 184, Corinth, were held without bond in the Aug. 14 robbery and slaying of Willie Louis Shelley, 39, of Baldwyn. Investigators said Shelley was beaten and shot to death and was robbed at his Bradley Street home.
Dennis Scales on Thursday evening remained in jail without bond, said Baldwyn Police Chief Troy Agnew.
At a hearing in Tupelo Monday, Circuit Court Judge Frank Russell ruled the proof was evident and the presumption great that Kenneth W. Scales had committed the crime of murder.
However, Russell ruled the proof was not evident for robbery in the case, the underlying felony required for a capital murder charge. Based on the ruling, Russell set a $100,000 bond.
Assistant District Attorney Jim Pounds, who represented the state at the hearing, said Dennis Scales' attorney also may file for a similar hearing to demand bond be set for him.
